ORDER OF THE BOARD

On July 27, 1983,
the City filed an appeal of permits
issued by the Agency to CID Landfill
#1 on June 22—23, 1983 for
Agency Log #404 and #410.
This appeal
is generally deficient
pursuant to Part 105 of the Board’s Procedural
Rules.
This is
a third—party permit appeal, but since the Board is not aware
of what “Agency Log #404 and 410” constitutes, the Board cannot
determine whether
it even has statutory jurisdiction of the
purported appeal, since
it is not clear whether hazardous waste
permits are at issue.
Likewise, the grounds of appeal
are not
stated.
If an amended petition remedying these deficiencies is not
filed within 15 days of the date of this Order, this action will
he subject to dismissal.
As these gross deficiencies are the
“fault” of the petitioner, the Board construes the 90-day time
clock as being tolled from July 27 until the date of filing of
an amended petition.
