OPINION AND ORDER OF THE BOARD

This provisional variance request comes before the Board
upon a January 27,
1983 Recommendation of the Illinois EnvironmenL~.
Protection Agency (Agency).
The Agency recommends that
a 45-day
provisional variance be granted to the Greater Peoria Sanitary
District
(District) to allow it to drain water in a flooded
150—acre sludge storage
lagoon system.
The District had been
granted a similar provisional variance on December 16,
1982
but did not accept it since it was limited to the draining of
a 50—acre area.
The Agency has concluded that compliance on a short-term
basis with the 5—day biochemical oxygen demand and suspended
solids limitations of Section 304.120 and the ammonia nitrogen
limitation of Section 304.301 would impose an arbitrary or un-
reasonable hardship.
It,
therefore, recommends
that a variance
be granted which is applicable to the entire 150—acre site.
The Board notes that a similar provisional variance was
granted to the District on April
15, 1982
(PCB 82—43,
46 PCB 117)
which required the District
to “proceed with plans to increase
the elevation of the existing levees,” as recommended by the
Agency.
This has apparently been accomplished.
Also,
no
dab~
for the commencement of this provisional variance is given,
so the Board will order
it
to commence upon discharge.
Pursuant
to
Section
35(b)
of
the
Act,
th•~
Board
hereby
grants
the
provisional
variance
as
recommended.
ORDER
The
Peroia
Sanitary
District
is
hereby
granted
a
provisional
variance from the Section 304.120 limitations
for BOD and sus-
pended solids and from the Section 304.301 ammonia nitrogen
limitation for a period of
45 days beginning
on the day that
discharge begins subject
to the
following conditions:

1.
The District informs Robert Broms,
Manager, Compliance
Assurance Section, Division of Water Pollution Control
(217/782—9720):
a.
the day discharge(s)
begins;
b.
the day discharge(s)
ceases;
2.
The two lagoons
(and any others)
containing the wet sludge
prior to the flood shall be dewatered to no more than a level
of one foot above the sludge;
3.
The remaining lagoons containing dry sludge shall he
dewatered to no more than
a level that will assure that no
sludge is discharged;
4.
The District shall make visual observations of its
discharge(s)
5 times per week and,
upon any noticeable change
in the discharg&s appearance that could indicate sludge
contamination, the discharge shall cease;
5.
The District shall sample the discharge for BOD,TSS,
volatile solids,
and ammonia nitrogen
5 times per week and
submit the results within 10 days after the end of each calendar
week to Robert Broms;
6.
The District shall execute
a certificate or acceptance
and agreement to be bound by the terms and conditions or this
provisional variance within 10 days of the date of this Order.
The certificate shall be addressed to the Illinois Enviromnen—
tal Protection Agency, Division of Water Pollution Control,
Compliance Assurance Section,

be
