    This provisional variance request comes before the Board upon
    a January 13,
    1983 Recommendation of the Illinois Envir.in~erital
    Protection Agency (Agency).
    The Agency recommends that a 45—day
    provisional variance be granted to Amoco Chemicals Corporation
    (amoco) to allow it to discharge the river water and wastewater
    now mixed in its eight flooded lagoons in an amount equal
    to
    the amount of flood water which entered the lagoons.
    The Agency has concluded that compliance on a short-term
    basis with the total suspended solids limitation of Section
    304.120(b) would impose an arbitrary or unreasonable hardship.
    Based upon the Agency’s conclusion and pursuant
    to Section 35(b)
    of the Act,
    the Board hereby grants the provisional variance subject
    to conditions as recommended.
    ORDER
    The Board hereby grants Amoco Chemicals Corporation a variance
    from the Section 304.120(b) limitation
    for suspended solids for
    a period of 45 days to begin within 10 days of
    the date of this
    Order subject to the following conditions:
    1.
    Amoco shall inform Robert Broms,
    Manager, Compliance
    Assurance Section, Division of Water Pollution Control
    (217/782—9720) of the following:
    a.
    the day discharge begins;
    b.
    the day discharge ceases;
    2.
    Amoco shall sample the discharge twice per week
    for the
    parameters listed in its NPDES permit and weekly for aluminum
    and submit the results within 10 days after the end of each
    calendar week of discharging to Robert Broms, Manager,
    Compliance Assurance Section;

    3.
    Amoco shall cease discharging if any of the results of
    the above tests exceed permitted levels for any parameter
    other than suspended solids;
    4.
    No sludge shall be discharged;
    5.
    Amoco shall discharge as much water to the wastewater
    treatment plant as is possible hut not less than 700,000
    gpd;
    6.
    Amoco shall develop and implement a plan to avoid
    the
    necessity of flooding its lagoons with a subsequent discharge
    in excess of permitted levels;
    7.
    Amoco shall execute a certificate of acceptance and
    agreement to be bound by the terms and conditions of
    this provisional variance within 20 days of the date of this
    Order.
    The certificate
    shall he addressed to the Illinois
    Environmental Protection Agency,
    Division of Water Pollution
    Control, Compliance Assurance Section, 2200 Churchill Road,
    Springfield,
    Illinois 62706 and shall be in the following
    form:
