ORDER
OF THE BOARD (by J.D. Dumelle):
This matter comes before the Board upon the January 12,
1983
receipt of an amended petition filed by Lewis University in
response to a more information order entered by the Board on
December
16,
1983.
The amended petition still
does
not fulfill the requirements
oF
Sections 104.12.1(a)
and
(k) or 104.124 of the Procedural
Rules.
The length of the requested variance has not been specified,
the cost of compliance
(e.g. what the hiring of a properly certi—
Iied operator would cost)
is lacking as
is the impact upon the
University of that cost, and hearing has been neither requested
nor waived.
The Board also notes that if hearing is to be
~~iaived
such waiver must be accompanied by an affidavit in support
of the material facts alleged and that more complete information
concerning hardship in general would be useful.
Unless Lewis University files an amended petition curin*J
the
above—noted
defects
within
45 days of the date of this
Order,
the
petition
will
be
subject
to
dismissal.
IT
IS
