On
February
9,
1984, the City of Wyoming (‘Wyoming) filed
a petition for variance from 35 Ill. Adm. Code 306.105(b),
restricted status.
It appears Wyoming in fact is asking for a
variance from sections 309.202 and 309.203 which prohibit
construction and operation of wastewater sources without an
Agency
permit.
The
petition
by
Wyoming
fails
to include certain information
necessary for a Board determination on this matter, including:
1.
What aspect of the municipal sewage treatment facility
is on restricted status, what is the basis for
restricted status, and when was restricted status
imposed?
2.
What is the current status of the problem leading
to restricted status, e.g., have flows increased or
decreased?
3.
What
is
the
schedule
for
completion
of
improvements
to lift restricted status?

•
What are
the
increased
flows
and environmental impact
from
the
sewers
for
which
variance
is
sought?
5
•
When
was
the
CAP
grant
requested
and
approved;
What
local
funds
have
been
expended
and
when?
6.
A description
of
the
existing
and
proposed
facility,
see
section
104.121(f).
7.
A statement as to consistency with federal law.

45 days of the
date of this Order curing the above—noted defects, this petition
will
he
subject to dismissal.
