    ORDER OF
    THE BOARD
    (by J.
    Anderson):
    P.~. 83—0425, effective September
    17,
    1983,
    modifies the
    Environmental Protection
    Pact by deleting former Section 22(h).
    It adds a new Section 22.1,
    providing that:
    By July
    1,
    1984,
    the Board
    shall adopt standards
    for
    the certification of personnel
    to operate refuse
    disposal facilities or sites.
    Such standards
    shall
    provide
    for,
    hut shall not be limited
    to, an evalu-
    ation of the prospective operator’s prior experience
    in waste management operations.
    The Board may provide
    for denial
    of certification if
    the
    prospective operator
    or any employee or officer of
    the
    prospective operator
    has a history
    of:
    1.
    repeated violations
    of
    federal, State or local
    laws,
    regulations,
    standards,
    or ordinances
    in
    the operation of refuse disposal facilities
    or sites;
    or
    2.
    conviction
    in this or another State of any crime
    which
    is a felony under the
    law
    of this State
    or conviction of a felony
    in
    a federal court; or
    3.
    proof of gross carelessness or incompetence
    in
    handling, storing, processing,
    transporting or
    disposal
    of any hazardous waste.
    The Board had previously initiated rulemaking concerning the
    “history” or “good conduct” portion of this mandate,
    in Docket
    R81—18.

    The purpose of this Order
    is
    to establish a docket concerning
    the “prior experience” portion of this
    legislation.
    The Board is
    presently in the process of researching rules promulaged by
    other states concerning this sublect.
    The Board anticipates
    initiation of inquiry hearings,
    as well
    as development of draft
    regulations
    in this matter, shortly after
    its receipt of the
    Agency’s proposal
    for updating of
    35 Ill.
    Adm. Code Part 807 and
    809
    formerly
    Chapters
    7 and
    J.
    Submittal of that proposal
    logically should precede action in this docket,
    as development
    of operator training and experience requirements is dependant on
    the landfill classification plan to be proposed
    in that docket.
    The Board has been advised that the Agency proposal concerning
    updating of Parts 807 and 809 will
    he filed within the next month.
