On July
1,
1982 the Board on
its
own motion opened this
docket and ordered that an Inquiry Hearing be held on the subject
of Emission Reduction Banking.
The purpose of this
inquiry was
to consider whether ~banking”
regulations were necessary,
and,
if
so, what issues should
he addressed,
The Board also noted that
the inquiry might provide
a basis
for
a regulatory proposal.
An
Inquiry Hearing was held
in Chicago on September
24,
1982,
at
which several witnesses supported
the
Board~s initiative
in this
area;
however,
no regulatory proposal has been forthcoming.
Given the lack
of
a
regulatory
proposal
in this matter,
the
Board today hereby dismisses this docket.
The Board notes that
this action does not constitute a
finding
that there
is no need
to establish a state regulatory
structure for Emission Reduction Banking.
Additionally,
the
Board notes
that
it has been advised that
a study on this subject
by the Department of Enerqy and Natural Resources
is nearing
completion.
