This matter comes before the Board upon a December 29,
1983
petition for variance from old Rule 205(n)(1)(G) of ~2hapter2:
Air Pollution (now 35 Ill. Mm. Code 215.204)
filed on behalf
of All—Steel,
Inc. (All—Steel).
That petition is deficient
under 35 Ill. Adm. Code 104.121 in that it fails to include
an environmental impact assessment.
The Board notes that the
proceedings in PCB 82—110 (All—Steel’s previous variance)
should probably be incorporated by reference, and that despite
the fact that hearing has been neither waived nor fequested,
hearing will be required.
Unless All—Steel files an amended petition curing the
above—noted defect within 45 days of the date of this Order,
the petition will be subject to dismissal pursuant to 35 Ill.
Adm. Code 104.125.
