This matter
comes
before the Board
upon a
December
30,
1984
second
motion for modification filed on behalf of the Department
of
the Army
(Army)
to which the Illinois Enviornmental
Protection
Agency (Agency) responded on January
6,
1984, concurring
in
substance.
The Army requests the modification of Paragraph
10(c)(3)
of the Board~sJuly 26,
1983 Order in this
matter
in that a
smaller dredge
(the Dubuque)
will
be
used
for
dredging
than
the dredge which was anticipated to be used
(the
Thompson).
Since
Paragraph 10(c)(3)
requires monitoring
based
upon the
length of
time the dredging takes,
and since the
dredging
will
take
5 times as
long to complete using the Dubuque
rather
than
the
Thompson, the total sampling cost would increase by a
factor of
5 as well.
The Board agrees that the increased cost is
unreasonable
and
grants the Army~smotion for modification.
The
Board
hereby
modifies Paragraph 10(c)(3)
of its Order of July
26,
1983 to
read as
follows
