On October 27, 1983 Conoco, Inc. filed a motion for sub-
stitution of petitioners in this permit appeal in that Conoco
sold its Amboy, Illinois hulk gasoline terminal for which the
subject permit was issued to Williams Pipeline Company. On
December 14, 1983 the Illinois Environmental Protection Agency
(Agency) filed a declaration in support of that motion “provided
that the Board condition any grant of substitution on the require—
nent that Petitioner provide the Agency with the required
APC 200 form and the proof of sale and purchase, and subsequent
transfer of the permit.”
The Board will not at this time rule upon the motion.
Rather, the Board hereby requires that the information requested
by the Agency he submitted to them by January 1.6, 1984 and
that both parties submit to the Board by that same date briefs
on the ic~ueof the legality of the transfer of
a permit appeal
pending
before the Board from one petitioner to another under
the facts of this case.
