ORDER OF THE BOARD (by J. Marlin):

This matter comes before the Board upon a July 31, 1984

filing entitled motion by petitioner to file instanter sup-

plementary information and in addition, a partial waiver of

the ninety day decision requirement.

The Board hereby denies the motion but accepts the sup-

plementary information as an amended petition. Since peti-

tioner has submitted additional information into the record

the Board considers the submission as a ~ tanto waiver of

the original ninety day decision period. To rule otherwise

would enable petitioner to submit vital information just be-

fore Board decision thereby leaving inadequate time for others

to comment on the submission. The ninety day clock for Board

decision starts anew as of the date of filing. The partial

waiver is unnecessary.
