ORDER OF THE BOARD

On March
1,
1984,
Pheem
moved this Board to reconsider the
January 26, 1984 Order in this case.
Rheem requested that the
240,000 lbs/yr VOC limitation of Condition #2 be deleted or
modified to 3,951 lbs/day.
The record here does not contain
positive statements that 3,951 lbs/day will not interfere with
attainment or maintenance of the National Ambient Air Quality
Standard for ozone.
If
Rheem
believes that number is supportable,
it is free to file another petition and provide justification for
its claim.
However, the present record is tied to a 20
reduction
in 1982 solvent useage,
i.e.,
240,000 lbs/yr.
Accordingly, the
Board imposed that limitation.
Rheem asserts this Board has no authority to limit Rheem’s
production.
Section 35 of the Environmental Protection Act
precludes variances that will cause air quality violations
Rheem’s statements of non—violation are tied to 240,000 lbs/yr
(Pet, par.
10).
The motion for reconsideration is granted, the motion to
modify is denied.
