THE
BOARD

On February 29,
1984, the Village of German
Valley
filed what
is purportedly a petition for variance, but which appears to be for
an extension of variance,
and which is deficient in either case.
First,
the petition fails to cite the docket number of
the variance proceeding for which an extension
is requested.
Further,
if the Village intends
to rely upon the record in that
previous case as the basic information for this case, which it
apparently does,
it should request that the record, opinion
and order in that case be incorporated into this proceeding.
However, the Board notes that it appears highly improbable that
no new facts have arisen regarding the eligibility of the current
operator to attain a higher operator classification,
e.g.
coursework,
experience
and test schedules or results.
Second, hearing must be either waived or requested.
Third,
the Village should have indicated what progress
has been made toward compliance during the term of the present
variar~ceand why an extension has become necessary.
Unless the Village files within 45 days
of the date of
this Order an amended petition curing the above-noted defects,
the petition will be subject to dismissal.
