for dismissal of this action on the grounds that Taracorp had
refused in
its
pleadings
to submit itself to the jurisdiction of
the Board.
Taracorp filed
a response
June 6,
to which the Agency
filed a reply June
7.
The motion to dismiss
is
denied.
Section 40 of the Act
gives
the
Board
subject matter jurisdiction in permit appeals and
Taracorp
in
its
May
29
filing
affirmatively states that it has
“submitted
its
person
to the jurisdiction of the Board”
(p.
2).
