ORDER OF
THE
BOARD (by J, Anderson):
On November 27, 1984, Park Ridge moved to dismiss its
variance petition without prejudice on the grounds that a “recent
ruling” by the Agency indicated that variance was unnecessary.
The City stated that the copy of the Agency’s letter was
attached, and requested the Board’s concurrence with the Agency’s
opinion.
The motion is granted. The Board cannot “concur” with the
l~gency’sjudgment as to necessity for variance since 1) it is not
usual Board practice to issue advisory opinions of this type, and
2) even if it were, the Agency letter was, doubtless inadvertently,
not included with the City’s withdrawal letter.
