    CONCURRING STATEMENT
    (by B0 Forcade):
    I generally agree with today’s Order, but would modify it in
    one respect.
    As adopted by
    the
    majority,
    in RCRA enforcement
    actions where
    the
    Board finds a violation, these procedural
    rules
    provide that the Board
    shall issue
    an interim Order and provide
    widespread public notification and opportunity to comment.
    Where
    the Board’s original finding is of no violation,
    the additional
    notification and opportunity for comment provisions do not apply.
    I would modify today’s Order so that the additional notification
    and opportunity for comment provisions applied whether the Board’s
    original determination found a violation or not.
