    On
    September
    28,
    1984,
    the
    City
    of
    Park
    Ridge
    (“Park
    Ridge”)
    filed an amended
    petition
    for
    variance
    in
    response
    to
    a
    September
    20,
    :1984~
    Board
    Order
    requesting
    more
    information.
    This
    matter
    will be held for Agency Recommendation.
    Because of new information provided in the Amended Petition
    the Board will,
    on its own motion, join the Metropolitan Sanitary
    District
    (t1MSD”)
    as
    a necessary party in this matter.
    The Board
    will provide the MSD with appropriate notice and all documents
    related
    to this proceeding.
    In order to provide the Board with a complete record for
    informed decision making and because of the confusing and con-
    tradictory
    quality
    of
    the pleadings to date,
    the parties are
    requested to submit the following information to the Board:
    1.
    Is the discharge for which variance
    is requested
    included in NPDES permit No.
    0044733, and what permit
    conditions apply?
    2.
    Which entity, Park Ridge or MSD, has been granted
    NPDES permit No. 0044733?
    3.
    What has MSD agreed to
    in relation to Park Ridge’s
    proposal?
    4.
    Is a variance really needed under these circumstances?
    5,
    Is
    Park Ridge merely requesting to raise the elevation of
    an existing outfall or discharge point?
    6.
    What
    will
    be the impact on the quality and quantity of
    the
    discharge
    from
    this
    action?

    Because
    of
    the information
    in
    the
    petition
    regarding
    the
    exi~ence
    of
    basement back—ups, the Board is proceeding with this
    matter~
    The
    Boards
    by
    so accepting this
    amended
    petition, retains
    the
    right to adjudicate the
    adequacy
    of
    this
    petition
    in
    the
    future.
    The Board
    is
    concerned
    with
    the
    potential
    adverse
    health
    effects from
    the
    basement
    sewer
    back—ups.
    The
    Board
    is,
    however,
    also concerned
    with
    the
    confusing
    and
    often contradictory pleadings
    to
    date.
    The
    parties
    are
    strongly
    urged
    to
    submit
    clear,
    concise
    and
    relevant
    information
    in
    future
    pleadings,
    not
    later
    than
    October
    24~
