On June
10,
1985, Petitioner LTV Steel Company,
Inc.
(“LTV”),
formerly known as Republic Steel Corporation and LTV
Steel Company,
filed
a Motion to Amend
the Board’s January 10,
1985, Order granting the variance in the above—captioned
matter.
Respondent Illinois gnvironmental Protection Agency
(“Agency”)
filed a response on June
26,
1985,
stating no
objection to
this motion.
Petitioner requests that
the Board
add,
as
a condition,
an
emission limitation
of 0.06 gr/dscf for the term of the
~iariance. Additionally, Petitioner requests that conditions

and
3
of the Order he amended
to allow LTV to apply for an
operating permit and
to file
a signed certification of acceptance
and agreement to the terms
and conditions of
the variance
instanter.
LTV states that the requested emission limitation is
supported
in the record and is required by United States
Environmental Protection Agency
in order
to obtain approval
as
a
revision to the State Implementation Plan.
LTV requests
modification of conditions
2 and
3 because, due
to an oversight,
neither the permit application nor
the certification were
tendered to the ~gency.
The Board will grant LTV’s motion to amend the January
10,
1985,
Order.
The Board will impose
a 0.06 gr/dscf limitation and
will provide until July 15, 1985,
for timely application and
filing of the above—mentioned documents,
The amended Order
is
provided
in full below.
ORDER
LTV Steel Company,
Inc.
(“LTV”)
is hereby granted
a variance
from 35 Ill. Mm Code 212.451
as
it applies to
the 44—inch hot
scarfing machine at Petitioner LTV’s South Chicago Works, subject
to the following conditions:

1.
This variance shall expire July
1,
1986,
or
60 days
after any final Board Order
or
a request for site—
specific regulatory relief
for LTV~s44~inchhot
scarfing machine located at
its South Chicago Works,
whichever
is earlier.
2.
During the period of this variance, emissions from the
above~mentionedhot scarfing machine shall
not exceed
0.06 gr/dscf.
3.
LTV shall apply to the illinois Environnental Protection
Agency (“Agency”)
for
an operating pen~itfor
its hot
scarfing machine no later
than July l5~ 1985.
4,
LTV shall execute a Certification of Acceptance and
Agreement to be bound to all terms and conditions
of
this variance,
including the emission limitations
set
forth in this amended order.
Said Certification shall
be submitted to the Agency at 2200 Churchill Road,
Springfield, IL 62706, no later than July 15,
1985.
The
form of the said Certification shall be as follows:
