This matter comes before the Board upon a motion to supplement
the record filed by the Agency and agreed to by petitioner on
September 4,

The Board hereby denies the motion but accepts the supple-
mentary information as an amended petition.
Since petitioner
has agreed to submittal of additional information into
the
record
the Board considers the submission as a ~
tanto waiver of the
original ninety day decision period.
To
rule otherwise
would
enable petitioner to submit vital information just before
Board
decision thereby leaving inadequate
time
for others to comment
on the submission.
The 120 day clock for Board decision starts
anew as
of
today.
