This matter comes before the Board upon an April 4, 1985
petition for variance filed on behalf of Electric Energy, Inc.
(BEt)
requesting variance from the total suspended solids (TSS)
limitations applicable to its electric generating station in
Joppa.
That petition is tisficient in numerous respects pursuant
to 35 Ill. Mm. Code 104.102.
More specifically, the petition
fails to include:
1.
The quantity of the materials discharged
(Section
104.121
(a)J;
2.
Data describing the extent of present non—compliance
Section
104.121 (a);
3.
Factual information supporting the environmental
assessment (Section 104.121 (g);
and
4.
ft dirv~n~ton
of compliance alternatives such as
dredging or ttn nse of flocculants and their
associated costs (Section 104.121 (i).
Unless EEl files an amended petition within 45 days of the
date of this Order curing the above—noted defects, this
proceeding will be subject to dismissal.
