ORDER OF THE BOARD (by G.T. Girard):
On February 26, 1999, third-party respondents, Kraft Foods Corporation and AC
Humko Corporation (Kraft), filed a motion to dismiss (Mot.) with prejudice the third-party
complaint. Kraft also filed a memorandum (Memo) in support of the motion to dismiss. The
Board has not received a response to the motion to dismiss.
However, on April 14, 1999, James and Carol Gilmer filed a motion to voluntarily
dismiss without prejudice the third-party complaint. The Board will grant that motion and
dismiss the third-party complaint.
