petition for variance filed on behalf of the City of Mount Olive

(City).

The City requests var:iance from unspecified NPDES permit

conditions

for

an unspecified period of time,

The Board does not have the

power

to

grant variance from

permit conditions;

it can only grant variance from Board

regulations which underly those conditions, thereby allowing the

Illinois Environmental Protection Agency to modify the permit.

Therefore,

the City must specify those Board rules from which

variance

is requested,

the

interim limitations

it requests and

the specific period of time for

which variance

is requested,

Unless the City files an amended petition within 45 days of

the date of this Order curing

the above-~noteddefects,

this

petition will be subject to dismissal,
