ORDER OF THE

This matter comes before the Board upon a September 12, 1985

joint petition filed on behalf of the City of Metropolis and the

Illinois Environmental Protection Agency (Agency) for an

exception to the Combined Sewer Overflow regulations of 35 Ill.

Mm.

Code 306.305(1) and (b). Pursuant to 35 Ill. Mm. Code

306.351, a discharger must have notified the Agency of its

interest in initiating the exception procedure by July 1, 1983,

and must have submitted certain information to the Agency by

October 1, 1983 in order to qualify for such relief. The present

petition contains no statements regarding whether these dates

were met. Therefore,.the Board cannot determine whether the

petition is properly before it.

Unless the parties file an amended petition within 45 days

of the date of this Order curing the above—noted defect, the

petition will be subject to dismissal.
