ORDER OF THE BOARD (by J.D. Dumelle):
This matter comes before the Board upon a September 11, 1985
petition for variance filed on behalf of Oasis Outdoor Ltd.
(Oasis). That petition is deficient in several respects. First,
the apparent waiver of hearing on page seven is unclear. Hearing
should be unconditionally waived or requested (although upon the
filing of a negative recommendation by the Illinios Environmental
Protection Agency, Oasis could reassert its right to a
hearing). Second, there is no data presented regarding current
discharge levels of the various pollutants from which variance is
requested. Third, on page three of the petition, variance is
requested for one year, while on page six Oasis alleges that
compliance will require more than one year. Fourth, there is
little or no discussion of the environmental impact of granting
variance.
Unless an amended petition is filed within 45 days of the
date of this Order curing the above—noted defects, this petition
will be subject to dismissal.
