the Illinois Environmental
Protection
Agency (“Agency~)
filed
a motion
to strike certain language
contained
in
the
Department
of Energy and Natural
Resources’
(UDENRU)
letter
of negative declaration from the
merit record
in
this proceeding.
That motion
is denied~
The
Board
is aware
of
the Agency’s concerns
and has addressed this issue
in
previous
Board
and Hearing Officer orders
(Board Order
of July 11,
1985;
Hearing Officer Order
of
September 16, 1985),
Additionally,
hearing has been scheduled
in order
to further
develop the record
in this area.
The Board, therefore,
denies
the Agency
motion to ~3trikeand
will address the issue
after
the close of the merit
record.
