OPINION AND ORDER OF THE BOARD (by N. J. Melas):
Pursuant to Sections 7.2 and 13.3 of the Environmental Protection Act (Act) (415 ILCS
5/7.2 and 13.3 (1996)), the Board adopts amendments to the Illinois wastewater pretreatment
regulations. As discussed more fully below, the adopted amendments establish effluent
limitations guidelines and standards under the Federal Water Pollution Control Act (FWPCA)
for a portion of the pulp, paper, and paperboard industry. The amendments are intended to
streamline the permit application process to more closely reflect the processes found in pulp,
paper, and paperboard mills in the United States.
Section 13.3 of the Act provides for quick adoption of regulations that are identical in
substance to federal wastewater pretreatment regulations adopted by the United States
Environmental Protection Agency (USEPA) pursuant to Sections 307(b), (c), and (d) and
402(b)(9) of the FWPCA (33 U.S.C. §§ 1317(b), (c), (d), 1342(b)(9) (1996)). Section 13.3
also provides that Title VII of the Act and Section 5 of the Administrative Procedure Act
(APA) (5 ILCS 100/5-35 and 5-40 (1996)), do not apply to this rulemaking. Accordingly, this
rulemaking is not subject to first or second-notice review by the Joint Committee on
Administrative Rules (JCAR). The federal wastewater pretreatment regulations are found at
40 C.F.R. §§ 400-499, interspersed throughout the federal wastewater effluent discharge rules.
Section 7.2(b) of the Act (415 ILCS 5/7.2 (1996)) requires the Board to complete its
identical-in-substance rulemaking actions within one year of the date of the earliest federal
amendments involved in a docket. In this docket, the sole federal action requiring Board
action occurred on April 15, 1998. Thus, the Board must complete its rulemaking activity in
this docket prior to April 15, 1999.
On December 17, 1998, the Board adopted a proposal in this rulemaking for
publication in the
Illinois Register
. See 23 Ill. Reg. 631 (January 15, 1999). Upon
publication of the proposal, a 45-day public comment period commenced. This public
comment period expired on March 1, 1999. No public comments were received during the
public comment period. As a result of its ongoing review of federal actions, the Board has
amended the proposal to include corrections to the federal April 15, 1998 action as detailed in
an August 7, 1998 federal action. Accordingly, the Board adopts the amendments
substantially as proposed, with minor revisions outlined below.

FEDERAL ACTION CONSIDERED IN THIS RULEMAKING
This rulemaking incorporates the federal amendments that occurred during the period
of January 1, 1998, through June 30, 1998. The USEPA amended its wastewater pretreatment
regulations once during that period. Although not enacted within the above stated time period,
the Board also incorporates into this rulemaking an August 7, 1998 federal action promulgated
by the USEPA which corrected errors contained in the action taken on April 15, 1998. As is
the Board’s custom, we include these federal corrections in this docket to minimize confusion
to the regulated community and general public. The two federal amendments incorporated in
this rulemaking are summarized as follows:

by reorganizing this section to better

mills. The amendments also require reduction
in the discharge of toxic and non-conventional
chemical compounds found in the effluents
from mills that fall within the “Bleached
Papergrade Kraft and Soda” sub-category and
the “Papergrade Sulfite” sub-category.
Additionally, the amendments incorporate best
management practices (BMPs) under the
FWPCA.
Pulp, Paper, and Paperboard Category
Correction. This action corrects minor errors
in the effluent limitations guidelines and
standards for hazardous pollutants promulgated
under the FWPCA for the pulp and paper
productions category contained in the April 15,
1998 action summarized above.
DISCUSSION

The USEPA amended its wastewater pretreatment regulations on April 15, 1998.
Those amendments consolidate into 12 sections what were once 26 sections of effluent
limitations guidelines and standards for the pulp, paper, and paperboard industry. This
reorganization also eliminated the separate category of “Builder’s Paper and Roofing Felt” and
integrates that category into one of the twelve new sub-categories. The USEPA indicated that
the purpose behind such reorganization was to establish a new scheme that better defines the
processes typically found in United States mills. Ultimately, the USEPA predicted that these
changes will result in streamlined regulations that can be implemented more easily by the
permit applicant.
The USEPA also revised the existing effluent limitations guidelines and standards for
the “Bleached Kraft and Soda” sub-category and the “Papergrade Sulfite” sub-category.
These revisions reduce the permitted discharge level of pollutants into publicly owned
treatment works by existing and new sources within these two sections. In addition, the
amendments promulgate BMPs under the FWPCA for a portion of the pulp, paper, and
paperboard industry. Except for the “Bleached Papergrade Kraft and Soda” section and the
“Papergrade Sulfite” section, the amendments contain no other substantive changes to the
limitations and standards applicable to the newly organized sections.
On August 7, 1998, the USEPA published corrections for five sub-sections that were
previously amended in the April 15, 1998 action. According to the USEPA, these corrections
merely fix “typographical errors and clerical oversights.” Based on the non-substantive nature
of this action, the Board has chosen to incorporate the USEPA’s actions of August 7, 1998,
into this action which would normally only contain amendments occurring between January 1,
1998, through June 30, 1998.
In this rulemaking, the Board adopts the federal amendments of April 15, 1998, and
August 7, 1998, by use of the actual text or through incorporation by reference, with only
minor deviations from the federal text. This includes alterations that the Board finds are
necessary to adopt the substance of the amended federal requirements into the text of the
Illinois water pollution control regulations. The Board tabulates below the deviations from the
federal text, including brief descriptions of the revisions.
