ORDER OF THE BOARD (by J.D. Dumelle):
This matter comes before the Board upon a petition for
variance filed on behalf of Western Illinois Power Cooperative,
Inc. on October 24, 1985 and a motion to dismiss the petition
filed on behalf of the Illinois Environmental Protection Agency
on November 1, 1985.
The motion to dism$ss is hereby denied. The Board finds the
petition for variance deficient in several areas pursuant to
35 Ill. Mm. Code 104.121. Specifically, Western Illinois Power
cooperative, Inc. should submit more information regarding the
cost of compliance with the effluent standard of 35 fl!. Mm.
Code 304.125, an assessment of the environmental impact on the
receiving canal, alternative measures for achieving compliance
and a full and adequate compliance plan.
Unless this additional information is filed with the Board
within 45 days of this Order, this proceeding is subject to
dismissal.
IT IS SO ORDERED.
