The Agency filed a motion to dismiss this

18, 1985. On November 4, 1985 counsel for petitioner
filed a
letter requesting that the Board defer ruling on the
motion to
dismiss for a period of four weeks. The Board construes this
request as a motion for continuance and a pro tanto
waiver. The
motion
to continue is granted. Since there is
no Board meeting
scheduled four weeks
from
today, the motion
to dismiss will be
ripe for decision at the
December 20, 1985
Board meeting and the
matter itself will be due for decision at the February 6, 1985
meeting.
