ORDER OF THE BOARD

The August 15, 1985 renewed application of Cynthia and
Ernest Carpenter for leave to
intervene as complainants
in this
action is granted.
Respondent’s August 12,
1985 motion to dismiss
or
alternatively to require a more definite response is denied.
As
noted
in complainant’s August
15 response,
the Board had ruled on
the bulk of the
issues presented in a similar motion directed
to
the initial
complaint, which motion was denied
by the Board June
27.
The August
15, 1985 motion
to quash the notice of deposition
for Mr.
Ed Steagall and the August 20 response thereto are
referred
to the Hearing Officer
for disposition: discovery
motions
of this type should be directed to the Hearing Officer
in
the first
instance.
Finally, the Board declines at this time
to impose the
sanctions requested in complainant’s August 15 motion.
In
so
ruling,
it is not
the intent of the Board
to countenance
discovery delay; respondent
is directed
to respond
to discovery
requests expeditiously.
Complainant
is given leave
to renew
its
motion in the event of non compliance with this directive.
