ORDER OF THE BOARD (by J. Anderson):
On September 5, 1985, the Board dismissed this action for
reason of Kable’s failure to file an amended variance petition
curing deficiencies noted by the Board in an Order of ~June27,
1985. On September 25, 1985 Kable filed a motion for
reconsideration accompanied by an amended petition. In support
of its motion, Kable states that it had not responded to the June
27 Order because it had not received the Order “due to apparent
mail problems.”
The
motion to reconsider is granted, and this action is
reinstated. The Board construes the 120 day decision period as
commencing today. As Kable has waived hearing the petition will.
be held for the Agency’s Recommendation.
