ORDER OF THE BOARD (by 1. Anderson):

On October 1, 1985, Electric Energy, Inc. (EEl) filed its

response to the Board~sSeptember 20 Interim Order rejecting the

stipulated settlement of the permit appeal. EEl moved for stay

of this proceeding, stating its intent to file a petition for

variance within 30 days. Decision has been waived until March

31, 1986, pursuant to an October 2 amendment to the October 1

filing. The motion recites that the Agency has no objection to

EEl’s request.

The motion for stay is granted until February 6, 1986,

subject to revocation if no variance petition is filed on or

before November 1, 1985. Extensions of this stay will be

considered upon review of the progress of any variance petition

filed,
