ILLINOIS POLLUTION CONTROL BOARD
    January

    IN THE MATTER OF:
    SITE—SPECIFIC RULEMAKING
    )
    R85—l5
    FOR THE SANITARY DISTRICT
    OF DECATUR,
    ILLINOIS
    PROPOSED RULE.
    FIRST NOTICE
    CONCURRING OPINION
    (by
    3.
    Theodore Meyer):
    I concur with the majority
in this opinion and order but
    I
    am concerned about
a 10—year time limit on rules.
    I feel both
the regulated community and the regulators
    need certainty before
    a commitment of capital.
    The regulated community will
    be
    hesitant
    to spend
large sums of money when the
    rules of
    the game
    can be changed.
