filed

a

letter which it states constitutes its appeal of certain

monitoring conditions of NPDES permit

IL 0062481 issued January

7,

1981.

This petition

is deficient,

as

it fails

to

specifically

state which conditions are the subject of the appeal as required

by 35 Ill.

Adm.

Code 105.102(b)(7), and does not indicate that

service has been made as required by 35 Ill.

Adm.

Code

1O5.1O2(b)(4).

Accordingly,

the Board on its own motion requires

a specification of errors pursuant

to Section 1O5.102(b)(7).

The

Board notes that inclusion of the information specified

in

Section 1O5.102(a)(2) would more

fully advise the Board

of the

circumstances of this appeal.

If an amended petition curing

these deficiencies

is not filed within

45 days of the date of

this

Order,

this action will be subject

to dismissal.

Finally,

since hearing cannot be

scheduled on the existing

petition due

to petitioner’s failure to file with the Board and

serve

the Agency with an adequate petition, the Board must deem

that petitioner has waived the

120 day decision period of Section

4O(a)(3) for the number of days petitioner

takes

to

file an

amended petition.

To aid petitioner,

the Board directs

its Clerk

to mail petitioner copies of this Order,

the Act,

and the

Procedural Rules via first class mail, certified mail service of

the Order to follow.
