ORDER OF THE BOARD

This matter comes before the Board upon
a December 30,
1985
Petition
for Exception
to the Combined Sewer Overflow Regulations
filed on behalf
of the City of Clinton
(City)
and the Clinton
Sanitary District (CSD).
The Board finds
that the petition
is
deficient
in several areas.
Specifically,
the City and CSD should submit more
information on the present justification for
the exception
pursuant
to
35
Ill. Adm. Code 306.361
(b),
(c)
and
(d),
the
environmental impact
of the Combined Sewer Overflows,
and
a
timetable for construction
of Alternative A should the exception
be granted and whether the ownership issue will
impede
the
construction.
Also, more information should be submitted
on
whether any enforcement actions have been initiated against
the
City
or CSD or
if
there has been any non—compliance with
variances granted
to the City
or
CSD.
Lastly,
the Board notes
that
it does not have the authority
to order
the Illinois
Environmental Protection Agency
(Agency)
to give CSD a grant for
a water quality study.
Such
a request should be directed
to the
Agency.
Unless this additional information
is filed within
45 days
of this Order,
this matter
is subject
to dismissal.
