INTERIM ORDER OF THE BOARD

On April 26,
1985, the Hearing Officer,
Mr Stephen Davis,
submitted to
the Board
a transcript of the April
15, 1985,
hearing held concerning the Illinois Environmental Protection
Agency’s enforcement action against Marathon Petroleum Co.
Within the transcript
is a motion on behalf of
the parties
for
a
60—day continuance
in which to submit
a Revised Settlement
Agreement.
Apparently this motion was not previously ruled on by
the Board
or the Hearing Officer.
The Board notes
that the
parties have failed to submit a revised agreement within the
60
day period.
The Board,
therefore,
orders
the parties
to submit
such agreement within 30 days of the date of this Order.
Alternatively,
the parties may proceed
to a hearing on the merits
to be scheduled within 30 and held within 60 days of the date of
this Order.
Otherwise, this matter will
be subject
to dismissal.
