ORDER OF THE BOARD (by

By letter of July 5,
1985, Citgo Petroleum Corporation
(Citgo)
articulated
its disagreement with Condition
4 contained
in
an NPDES permit
for
its Arlington Heights facility issued by
the Illinois Environmental Protection Agency (Agency) June
7,
1985.
Citgo noted
that “although
it
is the company’s opinion
and hope that this issue can be resolved by less formal means, by
way of this letter, Citgo
is requesting an adjudicatory hearing
to protect its right
to
a hearing.”
To protect Citgo’s rights,
the Board has docketed this
appeal.
However,
the letter
is lacking
information normally
found
in a petition
for review,
such as the full text of the
challenged condition,
and a description of the facility and its
processes,
see 35
Ill. Mm. Code 105,102(a)(2) and (b)(7).
In
addition, although the letter indicates that a copy was sent to
the Agency,
it would
appear that the
filing and formal service
requirements of
35
Ill.
Ad. Code 103,122 and 103.123 were not
met.
Therefore,
the Board orders Citgo
to file a more formal
petition for
review remedying the noted deficiencies, and to
formally make service of the petition as previously specified,
within
14 days of the date of this Order.
Finally,
this Order
should
not be construed as
staying the time by which the Agency
is
to file the record
in this matter.
