BOARD

On June
24, 1985,
the Environmental Protection Agency moved
the Board to impose sanctions on respondents
for failure
to
comply with an April 6,
1984,
Hearing Officer Order granting a
motion
to compel discovery.
Pierce filed a response
in
opposition July 2, along with a third set of supplemental
responses to
interrogatories.
Ruling on the motion was requested
prior
to July 17, 1985,
the date
of hearing.
The motion for sanctions is denied, as the Board
finds that
respondents have responded to the discovery requests.
In so
finding, however,
the Board does not condone the lateness of the
responses.
The July 2 motion to amend
the complaint
is referred
to
the
Hearing Officer
for disposition.
