RESOLUTION AND ORDER OF THE BOARD: (by 3. Theodore Meyer):

This matter comes before the Board upon a March 10, 1986

notice (51 Fed. Reg. 8199) published by the United States

Environmental Protection Agency (USEPA) of the promulgation of an

amendment to the National Emission Standards for Hazardous Air

Pollutants (NESHAPS):

Subpart N: National Emission Standards for Hazardous

Air Pollutants; Asbestos Correction

40 CFR 61 (35 Ill. Adm. Code 231.230)

Pursuant to Section 9.1 of the Environmental Protection Act,

the Board is required to adopt amendments “in substance

identical” to the federal NESHAPS amendments. The Board will do

so through incorporation by reference of the federal amendment as

a peremptory amendment. The Board will also update the CFR

reference to the 1985 edition.

ORDER

The Board hereby adopts the following amendment to Title

35: Environmental Protection; Subtitle B: Air Pollution;

Chapter I: Pollution Control Board; Part 231: Hazardous Air

Pollutants:

SUBPART M: ASBESTOS

Section 231.230 Emission Standard for Asbestos

The Board incorporates by reference 40 CFR 61, Subpart B N,
