today,

the filing of the variance case having been responsive to

the Board’s

Interim Order

of September

20, 1985 in this case.

Absent an additional waiver, decision

in the permit appeal

is due

on June

5.

Prior

to deciding this case,

the Board wishes

the

parties

to reevaluate

the permit appeal

in light of the Board’s

decision

in PCB 85—171

and

to advise

the Board to what extent,

if

any,

issues

in the permit appeal are mooted or otherwise altered

as well

as the parties’ positions on such issues~

Consistent

with

the June

5 decision deadline, EEl’s response

to this Order

shall

be

filed on or before May 16,

and

the Agency’s response on

or before May 27.

In the event

that EEl waives the decision

deadline,

the parties may apply

to the Hearing Officer for

extension of

this briefing schedule.
