ORDER OF THE BOARD (by B. Forcade):

On January 16, 1986, Bravo—Ernst Developers (“Bravo—Ernst”)

filed a Petition for Variance and on March 31, 1986, filed an

Amended Petition for Variance. Neither filing contain Proof of

Service on Illinois Environmental Protection Agency (“Agency”).

Under Section 37(a) of the Environmental Protection Act, a

variance petition must be filed with both the Board and the

Agency. Unless Bravo—Ernst files with the Board a proof of

service on the Agency by May 15, 1986, this matter will be

subject to dismissal.
