ORDER OF THE BOARD (by J. Anderson):
Interstate Pollution Control, Inc. (IPC) operates an on—
premises oil/water separation facility as well as a licensed
waste hauling facility in Rockford. On February 3, 1986, IPC
filed an appeal of decisions of the Agency’s Division of Land
Pollution Control which, on December 27, 1985, denied renewal of
the site’s operating permit, and also, on January 8, 1986, deemed
the application for renewal of 175 supplemental waste stream
permits incomplete. Interstate also filed a motion to
consolidate these appeals with PCB 85—155, involving denial of
air and water permits, as well as an emergency motion for stay of
the effect of these denials.
The day—old motions are not ripe for decision. However,
given the fact that the next Board meeting is scheduled for
February 26, nearly three weeks away, given IPC’s pleadings, and
given the Board’s unchallenged findings in PCB 85—155 that
economic harm to IPC outweighs any apparent harm to the
environment, the Board will at this time grant a temporary stay
until February 26. At that time, when the Board has the benefit
of the Agency’s responses as well as its permit records, the
Board will address the motion to consolidate as well as the issue
of a longer term stay. During the life of this short term stay,
IPC shall comply with the conditions of the expired permits.
