ORDER OF THE BOARD (by J.D. Dumelle):

This matter comes before the Board upon a February 4, 1986

Amended Petition for Variance Extension filed on behalf of the

City of Farmington. The Board finds that the petition is

deficient in that it fails to include either a request for

hearing or a waiver of hearing with an affidavit attesting to the

truth of the facts asserted in the petition pursuant to 35 111.

Adm. Code 104.124. Also, if any information provided in the

prior variance proceeding has changed, then it should be

specifically noted.

Unless the City files an amended petition within 45 days of

the date of this Order, this proceeding will be subject to

dismissal.
