ORDER OF THE BOARD (by J. Anderson):

Fedders—USA (Fedders) variance petition, filed April 10,

1986, is incomplete or unclear in the following respects:

1) Fedders has failed to submit compliance plan information

as required by Board Procedural Rule 104.121.

Referencing future intent to file a petition for a site—

specific rule is not sufficient.

2) It is unclear as to whether paragraph 6 and 7, of the

petition is to be construed as the filing of a Motion

for Reconsideration, out of time, of the Board’s January

9, 1986 order in PCB 83—47.

If an amended petition curing these deficiencies is not

filed within 45 days of the date of this Order, this petition

will be subject to dismissal.
