ORDER OF THE BOARD (by B. Forcade):
On July 29, 1986, Duo Fast Corporation (“Duo Fastt’) filed a
Motion for Leave to Present Testimony and for Scheduling Order.
Duo Fast requests that it be allowed to present testimony at the
RACT III hearings scheduled for the first week in September,
1986, and that it be allowed to file its written testimony with
the Board by August 8, 1986. This request would necessitate a
modification of the Board1s May 22, 1986, Scheduling Order. Duo
Fast represents that the Illinois Environmental Protection Agency
(“Agency”) has no objection to this schedule and would itself
prefer that Duo Fast’s testimony be presented at the September,
1986, hearings.
Duo Fast had previously requested that it be permitted to
submit prepared testimony on August 29, 1986, for presentation at
the September 3, 1986, hearing. This request was denied by the
Board on July 11, 1986, as the proposed pre—submission deadline
did not provide adequate time for review by the Board and other
interested participants. Duo Fast’s new proposed schedule for
pre—submission does provide sufficient time for review and
preparation. Duo Fast’s motion is hereby granted. However, if
the prepared testimony is not filed with the Board by 5:00 p.m.,
August 8, 1986, Duo Fast will not be provided with an opportunity
to present that testimony at the September, 1986, hearings.
