    ORDER OF THE BOARD (by J. Anderson):
    On July 18, 1986, Fritz filed alternative motions to dismiss
    or for summary judgment, to which the Agency filed an objection
    on July 25. Fritz filed a reply thereto on July 29, leave to
    file said reply being hereby granted.
    Based on these pleadings, the Board finds that there appear
    to be genuine issues of material fact which must be fully
    developed and addressed at hearing before the Board can make
    findings of fact on which it may base its conclusions of law.
    Fritz’ alternative motions are therefore denied.
    IT IS SO ORDERED.
