OPINION AND ORDER OF THE BOARD (by J.
D. Dumelle):
This matter
comes before the Board upon
a January 27, 1982,
petition
to adopt regulations concerning radiation hazards filed
on behalf of
the Department of Nuclear Safety
(DNS)
by the
Attorney General’s Office.
The Board adopted final regulations
on October
24, 1985 which were published
at
9
Ill. Reg. 19391 on
December
13, 1985.
Prior
to final adoption,
the Director
of DNS, Terry
R. Lash,
notified the Board
that in its January 24, 1985 First Notice
Order,
“wherever the published rules
refer
to ‘pico curies per
milliliter
‘(pCi/mi)’,
they should
be corrected by referring to
‘micro curies per milliliter
(uCi/ml)’.
This error occurs
in the
tables
in Appendix A
‘Concentrations
in Air Above Natural
Background’ and again
in
3.C.”..
The Board intended
to correct
this error by Order
of April
18, 1985,
wherein the Board ordered
that those changes
be made to the First Notice Order.
Unfortunately,
the error was not corrected
in the Board’s Final
Order.
Also,
a typographical error was inadvertently overlooked
in the Board’s Final Order.
In Section 1000.201: Definitions,
in
the definition “Rem”,
the word
“Therman” appears
in the table
within the definition;
the correct word is “Thermal”.
The Board
had hoped to simply file replacement pages to correct these two
errors in the rules but was informed by the Secretary of States’
Office that in order
to make these changes,
the Board must
proceed through First and Second Notice and the final adoption
prior
to filing of these corrections.
The Board adopted a Proposed Rule/First Notice Order
on
February 6, 1986, which proposed the following changes:
1)
in
section 1000.201: Definitions, the word “Therman” which appeared
in the table within the definition of “Rem” was changed
to
“Thermal”;
and 2) anywhere in the rules where “pCi/i” appeared,
“pCi/l” was substituted
in its place.

The Board adopted
a Proposed Rule/Second
Notice Order which adopted the above corrections without
change.
On June 23,
1986,
the Joint Committee on Administrative

Rules notified the Board
that no objection will be issued.
Accordingly,
the Board hereby adopts as final regulations
in R82—
2B the amendments made
to 35 Ill. Adm. Code, Part 1000 as they
appeared at first notice, without change.
