ORDER OF THE BOARD

This Docket is opened

in order to provide notification of

the Board’s intent to further update its RCRA regulations.

Regulations to be proposed

in this Docket,

R86-19, will encompass

the USEPA regulations adopted from February

1,

1986 through March

31,

1986.

These proceedings will be conducted pursuant to Section

22.4(a) of the Environmental Protection Act (Act).

Section

22.4(a)

provides that Title

VII of the Act and Section

5 of the

Administrative Procedure Act

shall not apply to regulations that

are

“identical

in substance”

to federal regulations.

The Board notes

that

it anticipates

the completion of the

R86-1 proceeding to update the RCRA regulations to encompass

USEPA regulations adopted from July 1,

1985 through January 31,

1986 in roughly

30 days.
