ORDER OF THE BOARD (by B. Forcade):
On May 16, 1986, the Army Corps of Engineers and Alton
Packaging Corporation filed a petition for variance from certain
regulations pertaining to Water Pollution Control. That Petition
is deficient in that:
1. More information is required on the quality
of effluent that will be temporarily
discharged to the “drainage ditch,” as well
as more information on the ditch itself
(including length, flow, present water
quality and any anticipated adverse impact
from the additional effluent); and
2. Greater specificity is required respecting
the term of the variance. The present
petition appears to request variance for one
month at some time over the next two years;
this should be clarified.
Unless an amended petition is filed within the next 45 days
curing these deficiencies, this matter will be subject to
dismissal.
The Board notes that the variance petition appears to seek
relief for both the Army Corps of Engineers and Alton
Packaging. If both entities are not “petitioners,” the Board
should be so advised.
