ORDER OF THE BOARD (by C.A. Manning):

On June 6, 2002, the Board, at the parties’ request, extended until September 16, 2002,
the time period within which Shearon, Inc. (Shearon) may appeal a May 14, 2002 determination
of the Illinois Environmental Protection Agency (Agency).
    See
    415 ILCS 5/40 (a)(1) (2000)
    as
    amended by
    P.A. 92-0574, eff. June 26, 2002; 35 Ill. Adm. Code 105.406. The Agency denied
part of Shearon’s request for reimbursement from the Underground Storage Tank Fund regarding
a leaking underground storage tank at 101 Ratloff Street in Harvard, McHenry County. Because
Shearon failed to timely file an appeal, the Board dismisses this case and closes the docket.

    IT IS SO ORDERED.

I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, certify that the Board
adopted the above order on October 3, 2002, by a vote of 5-0.

    Dorothy M. Gunn, Clerk
    Illinois Pollution Control Board
