    ORDER OF THE BOARD (by C.A. Manning):
     
    On May 16, 2002, the Board, at the parties’ request, extended until August 19, 2002,
    the time period within which Nicor Gas (Nicor) may appeal an April 16, 2002 determination of
    the Illinois Environmental Protection Agency (Agency).

    Ill. Adm. Code 105.208. The grounds for the permit appeal relate to operational flexibility in
    certain provisions regarding Nicor’s facilities located in Lake Bloomington (Station 40),
    Hudson (Station 41), and Lexington (Station 42) in McClean County. Because Nicor failed to
    timely file an appeal, the Board dismisses this case and closes the docket.
     
    IT IS SO ORDERED.
